Information We Collect and How We Use This Information

Mogotxt collects personal information when you register with Mogotxt, when you use Services (including Mogotxt's SMS messaging services), when you visit Mogotxt's website or the website of a subsidiary or affiliate of Mogotxt, and when you enter promotions or sweepstakes conducted by Mogotxt, a subsidiary or an affiliate of Mogotxt.

When you register with Mogotxt, we may ask for information such as your name, address, email address, mobile telephone number, your mobile carrier, birth date, age, gender, ZIP code, music preferences, and other personal information. When you register with Mogotxt and sign in to our Services, you are not anonymous to us.

Mogotxt stores, processes and maintains your messages, contact lists and other data related to your account in order to provide Services to you (including SMS messaging services).

When you use Mogotxt's SMS and other messaging services, Mogotxt's servers automatically record certain information about your use of Mogotxt. Like other web services, Mogotxt records information such as account activity (including storage usage, number of log-ins), data displayed or clicked on (including UI elements, ads, links); and other information (including browser type, IP address, date and time of access, cookie ID and referrer URL).

When you visit Mogotxt, we send one or more cookies - a small file containing a string of characters - to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends, such as how people use Mogotxt's Services. Uses

Mogotxt maintains and processes your Mogotxt account and its contents to provide Mogotxt's Services to you and to improve Mogotxt's Services. Mogotxt's Services include relevant advertising and related links based on the IP address, content of messages and other information related to your use of Mogotxt's Services.

Mogotxt's computers process the information in your messages for various purposes, including formatting and displaying information to you, delivering advertisements and related links, preventing unsolicited messages (spam), backing up your messages and other purposes relating to providing Services to you.

Mogotxt uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.

Mogotxt may send you information related to your Mogotxt account or new Services.

Information Sharing and Disclosure

General

When you send a SMS message by using Mogotxt's Services, Mogotxt includes information such as your Mogotxt SMS address and the SMS message itself as part of the SMS message sent.

We provide advertisers only with aggregated non-personal information such as the number of times one of their ads was clicked or otherwise responded to. Such information does not identify you personally.

We do not share your personal information with any third parties except in very limited circumstances such as when:

• (a) You have given us your consent; or
• (b) We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Mogotxt, its users or the public as required or permitted by law.

Mogotxt may also collect location information from your mobile device or your mobile carrier.

Children

When a child under age 13 attempts to register with Mogotxt, we inform the child that we must have the consent of the child's parent or guardian in order to complete the registration and we ask the child to have a parent or guardian create his or her own account with Mogotxt in order to help us verify the consent of a parent or guardian.

Mogotxt does not contact children under age 13 about special offers or for marketing purposes without the consent of a parent or guardian.

Mogotxt does not ask a child under age 13 for more personal information, as a condition of participation, than is reasonably necessary to participate in a given activity or promotion.

Your Ability to Edit and Delete Your Account Information and Preferences

General

If you do not wish to receive further communications from us to your mobile device, you may opt out of Mogotxt's SMS messaging services by sending the text STOP to Mogotxt's main shortcode from your mobile device.

You can also terminate your Mogotxt account by visiting our account termination page.

Children

Parents and guardians can review, edit, and delete information relating to their child's Mogotxt account using access provided by Mogotxt once the parent or guardian creates his or her own Mogotxt account as a parent or guardian.

If a parent or guardian chooses not to allow us to further collect or use a child's information, the parent or guardian can terminate their child's account by signing into that child's account and then proceeding to our account termination page.

Confidentiality and Security

We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.

We have physical, electronic, and procedural safeguards intended to protect personal information about you.

Changes to this Privacy Policy

Mogotxt may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your Mogotxt account or by placing a prominent notice on our site.
